1. In these Terms and Conditions 'Keith Prowse' shall mean Wembley Sports Arena Ltd. Trading as Keith Prowse.
2. Unless otherwise agreed in writing these Conditions, which supersede any earlier sets of Conditions shall override any Terms and Conditions stiuplated incorporated or referred to by the customers whether in the 'booking' or elsewhere and all Guarantees, Warranties or Conditions whether expressed or implied howsoever are excluded and hereby negated. No amendments to these Conditions whether expressed or implied howsoever are excluded and hereby negated. No amendments to these Conditions are allowed save those which may be agreed to in writing by an authorised officer of Keith Prowse.
3. Keith Prowse gives no warranty about the Event to which the hospitality is sold as to ist quality, suitability or otherwise.
4. The contract - A contract shall be deemed to have been made between Keith Prowse and the booking client when the client has confirmed requirements by letter, telex or facsimile and Keith Prowse has accepted such a booking.
5. Schedule of Payment
- A deposit as stipulated at the time of the booking must be paid to Keith Prowse within ten working days from the date of the booking. Otherwise the booking will be cancelled and the space resold at the sole discretion of Keith Prowse.
- Final balances must be paid to Keith Prowse no later than eight weeks prior to the first day of the booked Event.
- If the booking is made within eight weeks of the first day of the booked Event, the deposit and the final balance msut be paid to Keith Prowse within five working days from the date of booking.
- For bookings made within seven days of the first day of the Event and for additions made during the Event payment must be made by an authroized credit card.
6. Tickets and other admission document will not under any circumstances be issued prior to receipt and bank clearance of full payment relating to such tickets and admission documents.
7. Cancellation and alterations of bookings will be accepted at the sole discretion of Keith Prowse. In the event of the customer wishing to alter or cancel the booking any such alteratiojn or cancellation must be confirmed in writing to Keith Prowse. On receipt of such cancellation or alteration insturcitons, the following scale of cancellation and alteration charges will be applied:
- Cancellations
- Up to eight weeks before the first day of the booked Event - Full Deposit
- 4 - 8 weeks before the first day of the booked Event - Full deposit - 50% of final balance
- Less than four weeks before the first day of the booked Event - Full deposit - and the final balance
- Amendment Fee
A £10 administration charge will be added to the final balance for each amendment made to the original booking, save where the amendment increased the size of the original booking.
Cancellation and amendment charges are not penalties, but a genuine pre-estimate of the damage that would be caused to Keith Prowse.
8. Keith Prowse has no control over the running of the Event and all details and descriptions in relation thereto are for guide purposes only.
9. Keith Prowse cannot be responsible or liable whatsoever, for the non-appearance of any individual artist, performer, player or participant.
10. The details of the Event shown in any material supplied by Keith Prowse are correct at the time of printing but the customer shall be responsible for checking with the Event that no alterations have been made.
11. The customer hereby acknowledge that Keith Prowse have no control over the pricing policy of tickets for the Event and that any description of the position of seats is that of the Event of which Keith Prowse has no liability.
12. The tickets in any Hospitality Packages sold are subject to any terms, conditions and limitations of liability imposed by the owners or operators of the venue for which tickets are sold.
13. Keith Prowse shall not be held liable for any omission by any person not employed directly by Keith Prowse. Keith Prowse has no control over the Event and does not have any and cannot accept any liability for the actions or omission of the organisers or operators of the Event or their servants, agents or employees.
14. Keith Prowse shall not be liable for any loss, damage or expense caused by cancellation of the Event because of government action, strike, civil commotion, national disaster or other force majeur, in no circumstances shall Keith Porwse be liable for any consequential loss or damage, in any event Keith Prowse's liability shall be limited to the price of the Package.
15. Any complaints must be registered both on the day and in writing to Keith Prowse within 14 days of the last day of the Event. Keith Prowse cannot be liable for any complaints received after that period.
16. Keith Prowse has no responsibility for any property of personal effects at the Event.
17. If hospitality packages are to be posted to the customer rather than collected by the customer, risk in the goods shall pass to the customer upon the items being posted to the address given by the customer. Keith Prowse shall no be liable for any loss, damage or cost arising by non-delivery and reserves the right to levy an additional charge for issuing replacement tickets and documents for those lost whether in the post or otherwise.
18. Hospitality Packages and Tickets in them shall not be resold or transferred save as set out herein and shall not be purchased or obtained from or through any commerical agent or company or otherwise than directly from Keith Prowse or any appointed agent of Keith Prowse. If more than one package or ticket is issued to a customer those packages or tickets may be used only by those person intending to accompany that customer to and at the Event. The provision of such hospitality packages and tickets by a customer to such persons without payment shall not contravene these ticket conditions. Any hospitality packages or tickets obtained in breach of these conditions shall be void and all rights conferred or evidenced by such tickets shall be nullified. Any person seeking to use a ticket in breach of these conditions in order to gain or provide entry to or remain at an Event will be liable to be refused admission to or be ejectred from the venue and may be liable to legal action.
19. Hospitality Packages and Tickets therein shall not be used as competition prizes, or trade incentives, nor may they be used in raffles, tombolas, lotteries or draws whether for commercial or charitable purposes without the prior written authority of the Event which may withhold such authority at its sole discretion.
20. Unless otherwise agreed these conditions and the contract shall be subject to and construed in accordance with English Law and subject ot the exclusive jurisditions of the courts of England and Wales. It is hereby deemed that all contracts have been made in the jurisciction of the Wesminster County Court.
21. Keith Prowse give no warranties that the Event shall take place in the time and place stipulated or at all. Keith Prowse shall not be liable to give any refund in the event of the Event being cancelled or postponed save where the customer has insured against cancellation.
